Ajay Mankotia, the Founder of AMA Tax and Legal Advisory, has over 35 years of experience in Tax and Legal areas. As an Indian Revenue Officer (Income Tax) from 1982 till 2008, he handled Income Tax Assessments of Banks (including Foreign Banks), Financial Institutions, an RBI Subsidiary, Public Sector Undertakings and Foreign Companies. He has an insight into the working of Infrastructure Companies and has also handled specialized Income Tax Assessments including those relating to the Securities Scam (1992-96) that required an in-depth knowledge of the working of the Capital Markets and all the concerned institutions such as RBI, Stock Exchanges, SEBI and various intermediaries.
In CBDT, he handled policy and implementation with respect to judicial work of the Income Tax Department and worked closely work with the Ministry of Law and the Supreme Court. He also worked in the Investigation Directorate as Assistant Director of Investigation (in New Delhi) and Additional Director of Investigation (in Mumbai). He carried out search and seizure operations on large corporates and other entities across a wide spectrum of businesses for suspected tax fraud. As CIT (Appeals) , from 2001-02 , he handled appeals across an extensive range of businesses of varying sizes and complexities. As Commissioner of Income Tax, Varanasi, from 2007-08, he held the administrative charge of Varanasi and several adjoining districts, overseeing a wide variety of cases covering several industries of various sizes and complexities. He also oversaw the registrations of NGOs, trusts and charitable institutions.
When on Deputation at National Fertilizers Limited (October 2002 – September 2007) and other Fertilizer Companies ( BVFCL, HFCL, FAGMIL,PPCL, PDIL, MFL) as Chief Vigilance Officer (Functional Director) he was responsible for the overall control and superintendence of vigilance management in all the Companies. He worked closely with the Central Vigilance Commission, the Administrative Ministry and the Central Bureau of Investigation. He took several initiatives on preventive vigilance to improve systems and procedures, avoid leakage of revenue, improving transparency and raising the employee morale.
As President -Corporate Planning & Operations at NDTV (September 2008 – December 2017) he was overall responsible for Legal (General Counsel), Secretarial, Tax and Business Structures (both Domestic and International). He handled litigation/adjudication from district courts to the Supreme Court, Tax Department, ITAT, SEBI and SAT. He dealt with the Stock Exchanges, CBI, ED, TRAI, ROC, RBI, Ministries of I & B and Corporate Affairs as well as media industry bodies like NBA, IBF and NBSA. He handled mergers and acquisitions, strategic investments, truncation of structures, sale of businesses and buy back of shares/bonds. In tax, he handled a plethora of issues including investments, valuations, exchange of information with foreign tax authorities, international transfer pricing, international structures, legal interventions, among many others.
Having completed his B.A (Hons) in Economics from St Stephen’s College, Delhi University and M.A in Economics from Delhi School of Economics. Ajay Mankotia did his L.L.B from Delhi University. He also has D.E.S.S. (M.Phil.) in International Diplomatic Relations, University of Paris XI.
Ajay Mankotia has a Diploma in International Economic Relations from the International Institute of Public Administration (IIAP), Paris (May, 1987 – July, 1988) which has now merged with Ecole Nationale d’ Administration (ENA), Paris. He also did a course in Public International Law from the Hague Academy of International Law, The Hague, Holland and a course in ‘Preventing Fraud & Corruption’ from Royal Institute of Public Administration, London and a course in ‘Internal Affairs, Professional Standards and Ethics’ from Institute for Law Enforcement Administration, Division of the Centre for American and International Law, Plano, Texas, U.S.A.
During his tenure with the Tax Department and as CVO, he was a regular speaker at the training institutes of Income Tax Department, C&AG and CBI. The subjects included international taxation and taxation issues concerning foreign companies working in India, banks, leasing companies, investigation, vigilance, special audit, and others.
Ajay Mankotia has attended and addressed several international and national legal and tax conferences , such as the IICJ In-house Counsel Management Conference at Law Society, London, and several others.
Ajay Mankotia was adjudged India’s Finest In-House Counsel by Indian Corporate Counsel Association (ICCA) in 2017.
